VIETRADE - Investment preferential policies:

Land lease rate:

Annual lease rate amounts to 0.5% of the land value annually fixed by the Provincial People’s Committee. Considerations are given to peculiar land sites and certain business undertakings concretely stipulated as follows:

Land lease exemption, water surface lease exemption:

Investment projects falling under preferential business sector or location categories are exempt from land or water surface lease according to detailed stipulations in Article 14, Decree 142/2005/ND-CP of the Government, date November 4. 2005.

 

Business enterprise income tax:

Preferential business income tax validity applied to preferential sector and location categories are stipulated in detail in Article 34, Government Decree 24 /2007/ND-CP dated February 14, 2007.

 

Exemption, reduction of business income tax:

Investment projects falling under preferential sector and location categories are eligible to tax exemption or reduction according to detailed stipulations in Articles 35, 36, 37, 39 of Governmental Decree 24/2007/ND-CP date February 14. 2007.

 

Exemption of import – export taxes:

Imported commodities to make up fixed assets of investment projects benefiting from preferential sector and location categories are exempt from import tax according to stipulations in Governmental Decree 149/2005/ND-CP dated December 8. 2005.

 

Investment supportive policies:

Support to infrastructures works:

- Assurance of infrastructures building to the fence boundary of industrial park, industrial cluster, artisanal craft cluster, tourist site, urban center.

+ The Provincial People’s Committee provides support to communication road building and considers support to a general waste water treatment system of the whole area.

+ Thua Thien Hue Power Company  will invest in building the electric power system.

+ The Provincial Post Service will invest in building the news information communication system.

+ Thua Thien Hue Water Supply and Construction Company, Ltd will invest in building the water supply system.

- Investment projects outside industrial parks for necessity reason or investment projects in the compass of Nam Dong – A Luoi will benefit from the Provincial People’s Committee consideration for support in the amount of 30% of the estimated costs of building a water supply system and communication roads from the main local road axis to the project fence boundary, however this support should not exceed 2 billion VND. For import investment projects the support extent will be decided by the Provincial People’s Committee.

 

Support in resettlement compensation:

The Provincial People’s Committee will provide guidance to district, municipal People’s Committee to work with concerned services, agencies and the investors in arrangements for land clearance, compensation, handling over and leasing:

 

- As regards of the investment projects in Hue City and Huong Thuy District:

The investor is to make advanced payments for land clearance compensation, resettlement/ support. These expenditures will be deducted from payment of land utilization transfer right and land lease fees. When the deduction has not been completed upon expiration of land lease, it will be carried out over the extension of land lease. In case of lease expiry whereby the state recovers the land yet deduction has not fully covered advanced payments for compensation and resettlement support, the investor will be compensated according to regulations concerning compensation for land claim by the state.

 

- As regards of the investment projects in the compass of Huong Tra, Phu Vang, Phong Dien, Quang Dien, Phu Loc Districts:

The investor is to make advanced funding for compensation and resettlement support. The fund will be deducted from payment of land utilization transfer right. If deduction of land compensation and fixed asset on the land has not been completed by the time of land lease expiration it will be carried out over the extension of lease. (to be continued)
